Wellfleet Planning Board
Minutes of Meeting Wednesday, June 20, 2007
Town Hall Hearing Room, 7:00 p.m.

Present:  R. Dennis O’Connell, Barbara Gray, Gerald Parent, Alfred Pickard, Stephen Oliver, David Rowell; Rex Peterson, Assistant Town Administrator

Also Attending:  Building Inspector Paul Murphy, Chet Lay

Absent:  Ronald Harper

Chairman O’Connell called the meeting to order at 7:05 p.m.

Non-Compliant Structures
Building Inspector Paul Murphy was present to discuss non-complaint structures
with Planning Board.  The Board discussed the possibility of a new bylaw that would allow a ten-year old residential, non-compliant building to be treated the way a non-conforming structure is.   This would apply to buildings built after 1957, when zoning bylaws came into existence.  Barbara Gray said she’d like to check with Don Schmidt in Boston and report back to Planning Board before taking action on creation of a new bylaw to deal with non-complaint structure.  The bylaw change might also apply to commercial property, and the Board wanted to consider this further.   Peterson said a new bylaw could potentially be put on Special Town Meeting in fall.   

Adjustment on DSD #06-07 Daley, 2082 State Highway (Map 29, Parcel 129)
Chester Lay of Slade Associates came forward to represent Daley.  The new road is not yet built.  Joye Daley had requested that the first lot be released from the covenant.  This would allow her to sell the lot and get money to pave the proposed Kevin Daley Way.  Mr. Lay asked that PB release Lot 1.  Parent moved to release the lot.  Rowell seconded and the motion carried 6-0.  Lay will come back for the signing of the plan at the next meeting July 18, 2007.  Parent suggested that Lot 1 could be released and not put on the plan.  O’Connell suggested a few small changes for the Homeowners Association document.

ANR # 07-02 Thomas & Pluhar, 160 Briar Lane (Map 13, Parcel 112)
Chester Lay explained how this had been a Land Court case.  Thomas and Pluhar had been awarded two small portions of land (Area 1 and Area 3) through adverse possession.  Oliver moved to deem this an ANR. Gray seconded, and the motion carried 6-0.  

The “Airstrip”
There was a discussion of petitioning Land Court or Federal Court for right of way to the Town-owned “Airstrip” property (Map 42, Parcel 602) within the National Seashore near Marconi Beach.  

Rules & Regulations Revision
Examination of the Rules and Regulations continued at Section 4.05 “Road Construction” and progressed to Section 4.11 “Guard Rails and Posts.”  

 Minutes of 6/6/07
O’Connell moved to approve the minutes of June 6, 2007. Gray seconded, and the motion carried 6-0.

Adjournment
Gray moved to adjourn.  Parent seconded, and the motion carried 6-0.
The meeting adjourned at 9:05 p.m.
